Terms of Use

1. Agreement and scope

These Terms of Use (the "Terms") govern your access to and use of the Oyoni mobile application, website, and related features and services (collectively, the "Services"). In these Terms, "Oyoni", "we", "us", and "our" refer to the operator of the Services.

By downloading, accessing, creating an account for, or using the Services, you enter into a binding agreement with us and agree to these Terms, our Privacy Policy, and any feature-specific rules or notices made available to you. If you do not agree, do not use the Services.

2. Eligibility and accounts

2.1 Who may use the Services

You may use the Services only if you are at least 18 years old, have the legal capacity and authority to enter into these Terms, and are not prohibited from using the Services under applicable law. You must not use the Services if you are a convicted sex offender, have been charged with or convicted of human trafficking or modern-slavery offences, are subject to applicable sanctions or restricted-party lists, or are otherwise legally barred from using the Services.

Users who are found to be underage, particularly while hosting a live stream, may have their account permanently suspended. We may ask for government-issued identification, use third-party age-verification services, or use other reasonable means to confirm eligibility.

2.2 Account responsibilities

You must provide accurate, current contact and account information and keep it updated. You may not misstate your age, impersonate another person, create a misleading account, or use someone else's photo as your profile image. You are responsible for activity conducted through your account and for keeping your credentials secure.

You may close your account through the available account-deletion process. If your account is closed by you or us, your right to use the Services ends immediately. Subscriptions and access to purchased content may end, and unused virtual currency or other in-app items may be forfeited, subject to mandatory law.

3. Service access and changes

Oyoni provides tools for social discovery and real-time interaction, including messaging, audio/video features, live streaming, content sharing, music features, virtual gifts, rankings, and related paid features. We may use data analytics, artificial intelligence, machine learning, augmented-reality tools, and human review to improve the Services, support safety, and identify or remove unlawful or prohibited content.

We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of the app on your own device for lawful, non-commercial purposes. This license does not transfer any ownership or intellectual-property rights to you.

We may modify, suspend, remove, replace, or discontinue all or part of the Services; impose storage or usage limits; introduce charges for features; reclaim usernames; or limit the availability or visibility of content. Where required by law, we will provide notice of material changes.

4. Community rules and prohibited conduct

You must use the Services lawfully, respectfully, and in compliance with these Terms. You must not:

  • Use the Services for unlawful, fraudulent, unauthorized, or harmful purposes, or interfere with their operation, stability, or security.
  • Introduce malware; attempt to gain unauthorized access; reverse engineer, modify, or disrupt the app or its source code; or access the Services through means other than the interfaces we provide.
  • Publish or transmit content that is hateful, threatening, defamatory, abusive, violent, obscene, sexually explicit, unlawful, or otherwise inappropriate under applicable law or our rules.
  • Infringe privacy, publicity, intellectual-property, or other legal rights; impersonate a person or organization; or misrepresent an identity, relationship, or affiliation.
  • Conduct unauthorized commercial activity, advertising, sales, contests, promotions, barter, or solicitation through the Services.
  • Exploit, harm, or attempt to harm minors, or seek personally identifying information from minors.
  • Post your own or another person's contact details, home address, postal code, email address, URL, bank details, or payment information in your profile or elsewhere in the Services.
Additional live-streaming rules: Do not stream nudity or explicit sexual material; solicit, groom, or exploit minors; record or share another user's stream without consent; manipulate views, engagement, gifts, or rankings using bots or deceptive means; promote unauthorized goods or services; request another user's financial or personal information; or engage in scams, discrimination, violence, or other illegal activity.

5. Your content and intellectual property

5.1 Responsibility for your content

You are solely responsible for content that you post, transmit, display, or live stream through the Services, including its legality, accuracy, originality, appropriateness, and rights clearance. You represent that you own the content or have all permissions needed to make it available and to grant the license below, and that you have paid or will pay any applicable royalties, fees, or other amounts.

5.2 License you grant to Oyoni

When you upload, display, or otherwise make content available through the Services, you grant Oyoni an unconditional, non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, use, reproduce, process, adapt, edit, translate, publish, transmit, display, distribute, promote, and otherwise make the content available in connection with operating, improving, marketing, and promoting the Services.

This license permits Oyoni to enable other users, organizations, or individuals to access, share, broadcast, distribute, promote, or publish your content through other media and services where those uses arise from or are connected with the Services. No separate compensation is owed to you for these uses. You may remove your content to withdraw the license on a prospective basis, but this does not affect uses already made or copies retained by other users or third parties.

5.3 Our materials and third-party content

The Services, including their software, design, branding, text, graphics, and other materials, are protected by intellectual-property laws and belong to us or our licensors. Other users' content may be inaccurate, misleading, altered, or offensive. You use and rely on third-party content at your own risk.

6. Live streaming, virtual currency and gifts

Eligible users may host live streams. Stream visibility may depend on your privacy choices, user activity, and platform ranking or recommendation systems. Comments, likes, gifts, and other interactions may be publicly visible. We may use automated tools and human moderators to review streams, chats, reports, and related activity, and may record or retain streams for a limited period where necessary for moderation, safety, disputes, or legal compliance.

Live streaming is not an emergency service and must not be used to request medical, police, fire, or other emergency assistance. Other users may record, screenshot, or share content despite our rules. You should not disclose sensitive information while streaming or interacting with others.

"Coins" and virtual gifts are in-app virtual items. They have no value outside the Services, are generally non-refundable and non-transferable, and may only be used as expressly permitted in the app. We may change coin-package prices, gift values, visual effects, availability, and ranking rules where permitted by law. Gift transactions are final once sent, except where mandatory law requires otherwise.

7. Paid features, subscriptions and refunds

Some Services, content, virtual items, or premium features may require payment. Prices, taxes, fees, payment methods, and billing terms will be shown at the time of purchase. Where applicable, paid coins may be used before free coins. Pricing may vary by location, platform, or payment channel to the extent allowed by law.

Subscriptions renew automatically on the billing cycle shown at purchase unless you cancel them through the relevant store, payment provider, or account setting before the next renewal date. You are responsible for reviewing your purchase confirmation, renewal terms, cancellation steps, taxes, and final price.

App-store purchasesRefunds and payment disputes may be governed by the relevant app store or payment provider. Purchases linked to bans, violations, or consumed items may not be refundable, subject to mandatory law.
Direct purchases outside an app storeYou may contact support within 14 days of purchase to request a refund, subject to the payment channel, use of the item, and mandatory consumer law.

If a live stream is suspended or ended because of a violation, gifts already sent in that stream will not normally be refunded. Nothing in these Terms is intended to limit a non-waivable consumer right available under applicable law.

8. Moderation, enforcement and termination

To protect users, uphold our rules, and manage legal and operational risks, we may investigate activity and take action on content, accounts, or streams. To the maximum extent permitted by law, we may remove or decline to publish content, limit its reach, disclose relevant information to parties asserting rights claims, refer matters to authorities, suspend or terminate access, or take other appropriate action, with or without prior notice.

We may restrict, suspend, or terminate your account or live-streaming access for violations of these Terms, false age or identity information, underage streaming, fraud, repeated content violations, manipulation of metrics, unpaid charges, infringement of third-party rights, conduct that could expose us to liability, or other misuse of the Services. We may also take action where we reasonably consider it necessary to protect safety, integrity, or legal compliance.

You remain responsible for your conduct and content. You agree to defend, indemnify, and hold harmless Oyoni, its affiliates, licensors, partners, employees, contractors, and suppliers from claims, losses, liabilities, damages, and reasonable legal fees arising from your breach of these Terms, unlawful conduct, misuse of the Services, or content you make available, to the extent permitted by law.

10. Third parties, changes, governing law and contact

10.1 Third-party services

The Services may include third-party software, music, SMS verification, advertisements, payment processing, app-store features, or links to external websites and services. Your use of third-party offerings is subject to their own terms and privacy practices. We are not responsible for third-party content, availability, charges, transactions, or conduct. Carrier charges may apply to SMS features.

10.2 Changes and assignment

We may revise these Terms from time to time. We will publish the updated version and may provide notice by email, in-app notification, or another method required by law. Revisions take effect after any applicable notice period or when you expressly accept them. Your continued use after the effective date means that you accept the revised Terms.

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms and our related rights or obligations as part of a corporate transaction or otherwise where permitted by law. If you do not agree with an assignment or an updated version of the Terms, you may stop using the Services and delete your account.
